 1) General

These General Terms and Conditions of Sale (hereinafter "the GCS") apply to orders made by any person (hereinafter the "Customer") on the website www.bonange.fr or www.bonange.com(hereinafter the "website") of chocolaterie Sucre d'OR SAS (hereinafter "Sucre d'OR"), a simplified joint stock company with a capital of 12,000 euros, whose headquarters are located at 49 rue Lamartine, 78000, Versailles, France, registered at the Paris Trade and Companies Registry under number 850 659 319.

The GCS apply exclusively to all online orders made on the Website. No other special conditions from the Customer may prevail (unless expressly waived in writing).

 

The GCS may be modified from time to time. The GCS applicable to orders made on the Website are those in effect at the time the order is finalised by the Customer.

 

The order of products offered for sale on the Website is subject to acceptance of the GCS.

 

Questions relating to the characteristics and quality of the products sold on the Website, as well as nutritional information concerning them may be addressed to the Consumer Service:

Questions or complaints regarding the terms and conditions of orders as well as orders placed by the Customer on the Site can be addressed :

2) Connection to the website

To order, the Customer may either create an account on the Site before ordering, or order without creating an account, using the Website as a Visitor.

 

When the Customer creates an account, he communicates his surname, first name, postal address, telephone number and email address and chooses a password. His data is then stored by Sucre d'OR. His email address will be his login. He can then access his account using his login and password, order and consult the history of orders made. The login and password that the Customer will have defined when logging in will enable him to review and modify his data at any time.

 

When the Customer uses the Website as a Visitor, he communicates when ordering his surname, first name, postal address, telephone number and email address.

 

In both cases, the Customer must communicate in an exact and exhaustive manner the data required to process his order. The protection and confidentiality of Customer data is ensured by Sucre d'OR in compliance with § 10 of these GTC and its Privacy Policy.

 

 

3) Products and Availability

The products offered for sale on the Site are presented with their essential characteristics (price including tax, VAT rate, net weight, ingredients) to allow the Customer to have as much information as possible before ordering.

 

The photographs illustrating the products are not contractual in nature. Sucre d'OR is not responsible for minor variations in the presentation of the products and do not affect the validity of the sale.

 

The product offers presented on the Website are valid as long as they are online, within the limit of available stocks.

 

In the case of product unavailability, Sucre d'OR will inform the Customer by email or by telephone within two (2) working days following his order. Sucre d'OR may offer the Customer a product of a quality and price equivalent to the unavailable product. If this solution does not suit the Customer, his order will be cancelled and his bank account will not be debited.

4) Order

The Customer agrees to fill in the order form accurately and to fill in the various headings required to order (billing address, delivery address, payment option). The Customer guarantees the veracity of the personal information he or she has provided. The Customer may modify the contents of his cart and information entered in the order form at any time, especially in order to correct any entry errors, as long as he has not validated his order by clicking on " Order". As soon as the Customer clicks on the " Order " button, he agrees to purchase the products placed in his shopping cart.

 

As soon as the Customer has finalised his order online, an e-mail summarising the essential information of the order is sent to him. The Customer's bank account will only be debited after validation of the order by Sucre d'OR.

5)   Right of withdrawal

The right of withdrawal is excluded for the purchase of chocolates and Compositions. Indeed, in compliance with article L 121-20-2 3° of the French Consumer Code, the right of withdrawal cannot be exercised for products which, "due to their nature, cannot be reshipped or are likely to deteriorate or expire rapidly", which is the case for chocolate.

6) Prices and terms of payment

On the Website, prices are indicated in euros, including all taxes and excluding delivery costs (see Article 7).

 

Sucre d'OR may update or modify the prices applicable to the products at any time. However, prices are guaranteed from the moment the Customer places the products in his shopping cart. The Customer can only pay online by credit card (Carte Bleue, MasterCard, Visa, American Express) or Paypal.

 

Data is entered by the Customer on a secure banking platform using SSL encryption technology, guaranteeing the security and confidentiality of information during entry and during the transaction.

 

The order is only effective after the transaction has been authorised by the bank payment centers and then validated by Sucre d'OR. To be registered, the order must be paid in totality. Orders that have not been paid cannot be delivered.

7) Delivery

7.1 General

After confirmation of the order, Sucre d'OR commits to process and deliver the order to the delivery address indicated by the Customer, according to the mode of transport chosen by the Customer. Sucre d'OR insures the goods to the delivery address. It is up to the recipient to check the package in the presence of the deliveryman. Any anomaly during delivery must be the subject of written complaints indicated on the delivery slip in the presence of the carrier. The Customer has a period of three (3) days (excluding bank holidays) from receipt of the products to send the carrier a registered letter in which he describes the damage noted. In the event of a claim made against the carrier, the Customer must notify Sucre d'OR within three (3) days from receipt of the products.

7.2 Packaging

All packages are packed by Sucre d'OR in a sealed packaging adapted to the transport requirements.

7.3 Shipping Adress

The products are delivered to the delivery address that the Customer has indicated during the ordering process. This may be the Customer's address or the address of a third party, for example for the delivery of a gift order. In this case, the Customer provides his own contact details for the billing address. The Customer guarantees the accuracy of the data he or she has provided when ordering. In the event of an error in the wording of the recipient's details, Sucre d'OR cannot be held responsible for the impossibility of delivery to the recipient. The re-routing of the package to another recipient or to a new delivery address will be billed to the Customer.

7.4 Possible places of delivery

Deliveries are made exclusively in Metropolitan France and Corsica.

7.5 Delivery times

The delivery time for shipments to Metropolitan France and Corsica depends on the delivery option chosen by the Customer, which may be either "Standard" or "Express".

In order to guarantee Customers an optimal product quality, during the summer and in periods of high temperatures (>22°C), the shipment of orders may be delayed and is carried out when temperatures have dropped. The customer is explicitly informed of this postponement of shipment before confirming his order. In the case of high temperatures, Sucre d'OR reserves the right to postpone or cancel a shipment, with the Customer's agreement, particularly in the event of a heat wave.

In such cases, the Customer will be informed during the order process or by email.

Standard delivery time is 3 to 5 working days (Monday to Saturday) from the ordering date, excluding periods of high temperatures.

Notwithstanding the above, for orders over 25 kg that require a longer preparation time, Sucre d'OR endeavours to deliver products as quickly as possible. In this case, the maximum delivery time is thirty (30) days.

Due to the festive season, the delivery times may exceptionally be extended.

7.6 Shipping costs

The shipping costs related to the order are calculated according to the average total weight of the package(s) and the mode of delivery (Standard or Express.) The shipping costs are indicated in the Shipping Costs section and are reminded to the Customer when ordering at the time of choosing the mean of transport.

7.7 Late delivery

Questions regarding late delivery can be addressed :

The Customer may also request the cancellation of his order if the delivery has not taken place at the latest seven (7) days after the delivery date indicated by Sucre d'OR, unless this delay in delivery is due to a case of force majeure. Sucre d'OR will then proceed to refund the price of the product ordered at the latest within thirty (30) days following its request.

Sucre d'OR cannot be held responsible for a delay due to a case of force majeure, an error or omission in the delivery address indicated by the Customer.

7.8 Absence of the recipient at the time of delivery

In case of absence of the recipient or of a person who can take possession of the products at the time of delivery, the carrier will leave a delivery notice at the delivery address indicated by the Customer. This notice will indicate a delivery on the following day or will invite him to come and collect his products within fifteen (15) days at a specific pick-up point. Under no circumstances can Sucre d'OR be held responsible for a late delivery or a possible deterioration of the products due to their late withdrawal from the carrier.

8) Guarantees

The use-by date (UBD) for Sucre d'OR chocolates is indicated on each product containing chocolate. The average remaining UBD of the products delivered is ten (10) to twelve (12) months. Sucre d'OR guarantees the quality and freshness of its products by keeping them in a cool place (between 14 and 18°C), away from light. Sucre d'OR encourages the Customer to check the goods delivered on receipt and to compare them with his order. Any complaint must be made within a maximum period of 3 days after receipt, to the Consumer Service, by registered letter with acknowledgement of receipt to : Sucre d'OR SAS, 49 rue Lamartine, 78000 Versailles, France. In the event of a defective product or a non-compliant order, the Customer is entitled to demand its replacement by Sucre d'OR. If the replacement of the product ordered by an identical product is impossible, or cannot be implemented by Sucre d'OR within one (1) month following the Customer's claim, the Customer may either return the defective product or the non-conforming order and obtain a refund (including shipping costs); or benefit from a price reduction after analysis and acceptance of his claim by Sucre d'OR.

In the event of a return, the item must be returned to Sucre d'OR within 14 days of receiving it. The Customer must send it in its original packaging or in another packaging that guarantees safe transport, enclosing a copy of the bill, to the following address:

If the Customer opts for the reduction of the purchase price, he will keep the product and Sucre d'OR will reimburse him the amount of the agreed reduction, by re-crediting the card used for the online payment of the order (secure transaction), within seven (7) days.

 

9) Retention of property

The delivered goods remain the property of Sucre d'OR until full payment of the purchase price. The transfer of risks to the Customer takes place as soon as the order is delivered.

10) Use of data / Data protection

Sucre d'OR applies the provisions of Law n°78-17 of  January 6th 1978 relating to information technology, files and freedoms. The information relating to the nature, extent and purpose of the collecting and storing by Sucre d'OR of the personal data required for the execution of the purchase contract is set out in our Privacy Policy.

 

11) Limitation of responsibility

Sucre d'OR may not be held responsible in the event of non-execution or poor execution due to a case of force majeure as defined by the jurisprudence of French courts. Similarly, Sucre d'OR cannot be held responsible in the event of damage resulting from the Customer's use of the Internet network.

 

For customers suffering from food allergies or diabetes, it is advisable to consult the nutritional information and lists of ingredients indicated on the packaging as well as on the product description page on the Website.

14) Applicable law

The applicable law is French law.

The application of the United Nations Convention on Contracts of International Sale of Goods is excluded.
